Today, October 29, 2010, Judge Rick Brown of the Riverside County Superior Court entered a verdict for the plaintiffs in a certified national class action lawsuit. The court entered a verdict against Heidi Diaz the owner of the diet website Kimkins.com for fraud and false advertising. The court awarded the class members restitution in the amount of $1,824,210.39. The court also awarded an additional $500,000 in punitive damages as well as attorney fees. The court then issued a temporary restraining order to freeze all of the assets of Ms. Diaz.

Most notably, the court also imposed an injunction requiring Heidi Diaz to post on all of her websites that: (1) she lied about her weight loss; (2) she lied about her after diet pictures; (3) she lied about testimonials on her website; and (4) she lied about the photographs used with the testimonials to promote the Kimkins website.

An injunction was also issued to prevent Heidi Diaz from contracting, harassing or cyberbulling the plaintiffs and the witnesses. A formal judgment will be entered before November 19, 2010.

The original complaint was filed over three years ago on October 15, 2007. I want to thank everyone who supported the class action lawsuit. The Ducks were wonderful. I met a lot of great people and made a lot of new friends fighting for a good cause. Heidi Diaz lied on her website and made the fatal mistake of lying in the courtroom. You cannot trust Heidi Diaz. I anticipate more legal (illegal) maneuvering by Heidi Diaz to evade the judgment. We will be prepared and I will be relentless. Again, I thank all you.

The Worst Diet Promotions of 2008 snag 20th Annual Slim Chance Awards

HETTINGER, ND – Healthy Weight Network released its 20th annual Slim Chance Awards today, highlighting both the hidden dangers of diets and supplements that often contain unknown ingredients and sometimes potent drugs, and the merely ridiculous.

To call 2008 a typical year in the weight loss field would be too easy. This year’s awards go to an infamous huckster of diet infomercials, known for his outrageous disregard of injunctions against him; $139 body-shaping jeans impregnated with substances that supposedly reduce cellulite; a pill that’s “proven” to make your belly fat vanish; and a dangerous starvation diet launched recklessly on the Internet with false promises of safe, fast and permanent weight loss.

All in all, a typical year that synthesizes all that is deceptive and exploitative in this field. So, here they are, the 20th annual Slim Chance Awards (only “Worst Product” is shown here):

WORST PRODUCT: Kimkins diet. It must have seemed an easy way to get rich quick. Founder Heidi “Kimmer” Diaz set up a website and charged members a fee to access the Kimkins diet, boasting they could lose up to 5 percent of their body weight in 10 days. “Better than gastric bypass,” there was “no faster diet,” and in fact she herself had lost 198# in 11 months. Stunning “after” photos were displayed. In June 2007 Women’s World ran it as a cover story, and that month alone PayPal records show the Kimkins site took in over $1.2 million. Then users began complaining of chest pains, hair loss, heart palpitations, irritability and menstrual irregularities. This was not surprising since Kimkins is essentially a starvation diet, down to 500 calories per day and deficient in many nutrients (shockingly, laxatives are advised to replace the missing fiber). In a lawsuit, 11 former members are uncovering a vast record of Diez’s alleged fraud. They found that the stunning “after” photos, including one of Kimmer herself, had been lifted from a Russian mail order bride site. According to a deposition reported by Los Angeles TV station KTLA, Diaz admitted using fake pictures, fake stories and fake IDs, and a judge has allowed the litigants to freeze some of her assets.

Ducky just decided to fade away into the unknown. The blog was pulled, the photos were pulled. The account wiped clean. Even the email no longer works.

Why??

Did ducky feel like all the work was done in bringing Heidi down??

Did Ducky get cold feet??

We will probably never know why they decided to pack it in. Our many questions will most likely go unanswered.

I may ruffle a few feathers but I’ve got to say my piece here. Many of us have busted our rear ends doing things to further tighten the noose on ol’ Heidi, adding one more nail in the coffin. Does Ducky not realize how much valuable information was lost when they decided to pull the blog. Or do they just not care any more.

I fully understand possible activist burnout. I’ve hit the wall many times over the years in the fight for various causes. But I never just gave up. Deleting the blog was childish in my opinion. If they weren’t interested in the fight anymore it would have been very easy just to leave the blog dormant or pass it on to someone who would use it.

Were they afraid someone may find out their identity??

I say so what.

The fight is long from being over with. The truth STILL needs to be told. Oh yeah….one more thing to say…..

No, she will simply try to say they stole all her pictures, or else she will admit sooner or later that she is obese but she DOES know people who lost from Kimkins and she was just ashamed she couldn’t. While we are all right in our exposing her, I have felt through this whole thing that perhaps she is just UNABLE to lose…at least this way….and she has other health concerns.

Why is it soooo damaging to one’s perception of people that many of you have latched onto and keep repeating this idea that Heidi Diaz suffers from some sort of mental problem/instabilty? Quit it. All you’re doing is giving her ideas and the notion credibility.

Does it allow you to sleep at night to think no one could simply be that callus and uncaring? Calculating and manipulative? After all, you’d have to be mentally ill to do and say whatever was needed to to separate people from their money and actually take pleasure in puppeteering people in their Dance of Guilibility? I have faith in people and I know that there are a lot of people out there that will do the research and find the horrors of the Kimkins diet, the bannings of “lifetime” members for no reason other than to take their money from them, the no feedback from Kimmer herself on the site as promised and the dangers of the starvation diet that Kimmer (Heidi K. Diaz), who never even lost the weight herself, promotes. Ban Kimkins in 2008 and find a free and safe diet site to support your weight loss efforts in 2008. The year you will succeed WITHOUT Kimkins starvation diet!

man oh man I totally forgot about posting that harsh comment to the blogger formerly known as Truth. I’m sorry, Truth, that was really unkind of me to phrase my honest disappoint in such harsh terms.

What I mostly was feeling so upset about was that in blogging about the contents of Heidi’s pm system, you blew an unprecedented access that could have, if kept totally private and reported solely to the authorities and to JohnTiedt, still be bringing in a wealth of information.

Since I’m entirely obsessed with my self of course and since my personality is revelatory and confessional, I’ll say right up front (or wherever this is) that I’ve been guilty at times of indulging my egotistical urge to blab. But never have I had access to Heidi’s pm system.

eh, if I had, I’d probably have done exactly what you did — blab about it, and thereby blown a priceless resource.

When you first started posting the inside info, I chimeed right in with the applause and the ooh’s which were entirely heartfelt. It was only later, in hindsight, that I realized what it all actually meant in relation to the big picture. And I was more than a bit annoyed.

Still, it was rude of me to post that harsh comment to you, and I’m truly sorry for being so hateful.

Of course I don’t expect you to forgive me and hey, that’s ok too.

I can’t really talk about the PMs too much, but when I first revealed them, I no longer had access to them live, so I figured no harm in releasing them for the general education of the public. After that, I gained access again for a time.

I can’t imagine messages of this sort being admissible in any way to the court case though. In fact, I’m positive John’s response would have been, “I don’t want to hear about those messages and I don’t want to know how you got them.”

So what do we do with information that is begging to be shared but isn’t useful in a legal sense?

Yep, LCF boards appear to be down. I was able to go to LCD and to the main board page, but was unable to access specific links such as Stillmans etc.

Can’t wait to see what Darth Kimmer still has up her sleeve.

My prediction is her next spin will be to play her sympathy card. She will take a page from the Paris / Brittney playbook.

I AM SO PISSED that I didn’t save a copy of it! Others had gone on and edited & added so much stuff, it was really growing. I hope it will come back – I’ll spread the word when it does. Glad you appreciated it!

Okay, so it’s lame, I know…I knew Susan was a fake even when I signed up because the before picture was in NO way 290 pounds and looked 39402 years older…but I still hoped maybe I was completely wrong and she had tons of plastics done since I’m a college student too and had the same stats nearly.
I was so pathetic to keep hoping, though I kept arguing and telling myself that it was impossible that was teh same person.

Ooooooooooh and what makes me more mad is Melissa! I knew her after picture looked funky. I thought she was WAY beautiful in the before picture and didn’t get how her after picture was so much better.
Being the same faith as ‘Melissa’ and some of the same sorts of symptoms (PCOS), I knew it was too good to be true.
I think Heidi would sift through forums and see what people were talking about and create stories to cater to their needs to suck in more people!!!

Besides all that, you can always tell when it’s fake because the beginning of the story is some lame-o introduction that sells the product, just like the lame-o ebook!

36 Pounds Lost & New Life After Divorce!

Hello all! I’m Genevieve.

If you notice my “before” photograph you’ll see a pudgy and depressed woman. That was me. I was comtemplating why my life felt so out of control. I was making bad food choices and using every excuse under the sun to overeat.

I had recently separated from my husband of 9 years. We live in a community property state and the cutoff date to avoid long term alimony payments is 10 years. His reason? He needed a change. He also earned a six figure salary as a sales manager that he wanted to protect. It’s amazing to think that the person you think you know the best turns out to be a total stranger.

During our divorce I found out about secret affairs he had with many women. He had been paying one woman’s rent and car payment! My life felt like it was cycling out of control. Nothing made sense and I was afraid to make any decisions. My sister finally asked me to meet her for lunch (yummm, more food) and sat me down. We had a sister heart to heart and I told her everything. She suggested I do something to take my power back.

Good idea. I began seeing a divorce therapist to help me deal with my growing sense of loss and devastation. After listening to my complaints about gaining weight, she suggested I get serious about finding a diet plan. I had no idea where to look because I had never had an obesity condition. I knew the diversion would be good for me.

After calling the diet plans I saw advertised on TV and the high prices involved I realized that the diets worked by not leaving you enough money for food. I went to Barnes & Noble to look at diet books. As I browsed I saw a diet brochure in a woman’s purse. I hadn’t heard of it and asked what she thought. She raved! Turns out she was a sales affiliate and answered all of my questions. She also showed me her before and after photos. Big difference!

Once I joined I kept in touch with the affiliate (thanks Nikki!) The diet was easy enough to follow, but sometimes I did have questions about whether a food was “legal”. My high school students noticed my weight loss after the first week and gave me extra encouragement!

Now that I’m at goal weight I’ve got a new outlook on life. Being overweight doesn’t stop your life, but it sure slows it down. Thankfully I’ve got the tools I need to maintain my weight and I’m spreading the word to others!
