Kimmer Plays it Cool

3 10 2007

This morning, after KTLA’s segment last night, featuring Kimkins as an ‘internet scam’, Kimmer (Heidi Diaz) is downplaying the significance of the broadcast and remains calm and cool to members.

With no remorse or explanation about the broadcast, Kimmer is posting away in an attempt to quiet any questioning, and banning members who dare speak up.

On the thread ‘Ask Kimmer’ a member wrote:

Just want to publicly throw in my two cents about all the controversy swirling around us. I know you would get a lot of flack if you did this, Kimmer, but–I wouldn’t care a bit if you took out all the negative stuff. I think the time for reaction to and self-_expression_ regarding all the people leaving, the lawsuit, etc. needs to have run its course. Those of us who are trying to focus on the program keep running into all that “stuff” on just about every thread we turn to. Enough is enough!

Kimmer replied:

I know. We’re doing our best to keep it off the site. People who enjoy reading it can find it at 1,001 other places. Meanwhile, stay focused, do your work, let your body show you what it can do!

On another thread, Kimmer wrote:

Maybe I can shed some light?

The point of this website — the entire reason it exists — is to help people lose weight. When there’s interference with that intent, we take action. Whether that is banning troublemakers or removing elements that distract from our purpose, we do it.

Personally I don’t like negativity on this site. I’ve said it a thousand times and I still mean it. If anyone is unhappy or disillusioned, there are a ton of other websites to vent your feelings. Or, start an anti-Kimmer blog like the “popular kids”. Sorry, bad humor. Everyone is 100% to their opinion. Absolutely. Just take the negative opinions elsewhere.

Or, you could just lose weight?

Those of you who have been members since the website started have seen regular changes to the front page. I think we are on #5 “facelift”? Our graphic guys get bored and every few months they get an urge to make changes. Unfortunately, this change was stopped midway. The brother of our lead graphic person is having open heart surgery and the balance of the design changes have been postponed a few days.

They’ve got ideas for another front page change a few months from now. It’s the nature of the beast.

And on yet another thread, inquiring about the removal of success stories from the site, Kimmer wrote:

I’m right here!

We are renovating the front page. We needed more space on the top menu bar so some elements were removed. Success stories are still there in photo form on the right side and expanded to show 5 at a time. We’ll be adding 3 new success stories this week!

The naysayers would love for me to chat on … so I won’t. We’ve got some new support resources for members coming up, too! Keep an eye out!

If you have not yet watched the KTLA broadcast, you can watch the video here. Tonight KTLA will broadcast part 2 at 10:00 PM PDT.

BBB Downgrades Kimkins Again

27 09 2007

This morning, the BBB updated the Kimkins listing once again, with yet another downgrade.

Today the company is graded as “D”, which in BBB speak means,

We [BBB] have enough concerns about this company (for example, their offer, customer complaints, advertising, etc.) that we recommend caution in doing business with it.

You can visit the BBB here, and while you’re there, file a review. You can also, if you feel it appropriate, file a complaint. Just remember, review first, then file your complaint.

The BBB Offers Summary of Complaints

26 09 2007

The BBB website was once again updated, this time to include a summary of the complaints they are receiving about Kimkins.

The summary ‘Complaint Experience’ provides this information:

Complainants allege that the E-book they thought they would receive for their membership fee, consisted of a one page information sheet, or, they received nothing at all. Some complain the company fails to provide on line support as advertised, or complain that the company’s owner has no medical or other educational background that would qualify her to promote the diet plan. Still other complainants report that company administrators are used as shills in testimonials, and that professional models are used for after pictures. Other customers’ express health risks and concerns,’ alleging the diet plan promotes the use of laxatives, and anorexia. Many complainants reportedly experienced health problems as a result of using the plan. Most complainants requested refunds. A few customers report that after complaining, they were denied access to the company’s website.

The company responds to a few complaints by advising they had fulfilled their obligation to the customers. Allegations of health risks were not addressed.

BBB Downgrades Kimkins Rating Again

21 09 2007

The Better Business Bureau (BBB) has again, for the second time this week, downgraded their rating of Kimkins, this time from CC to C.

It appears they have also removed at least 3 reviews since yesterday morning when 100 were listed and today there remains only 97 to view.

If you would like to write a review, the page is here. The complaint form is on the same page and we’d like to remind those intending to review or complain that you should post your review first and then file your complaint since you will not be able to write a review for twelve months after your complaint is closed! Review first, complain second!

Getting to Know Tippy Toes

11 09 2007

One of the newest admins at Kimkins is Jeannie Baitinger, aka ‘Tippy Toes’ in the Kimkins forums and Low Carb Friends forums. For the purpose of keeping things simple here, we’ll refer to her as ‘Tippy’ throughout.

Tippy joined Low Carb Friends back in April 2004 when she started a low carbohydrate diet (Atkins) and weighed 263 pounds. Since that time she’s admittedly struggled to lose the weight desired and declared herself at goal on September 8, 2006 after losing 100 pounds. In the last year she’s maintained her weight between 150 and 155 pounds, alternating between Atkins and Kimkins. Why we make this an issue is that she recently wrote a positive 5 star review at the BBB for Kimkins, on September 7, 2007,

This is the BEST weight loss website I have been to yet! Thanks to I have lost 112 lbs, have never been sick, got off blood pressure and cholesterol meds and I feel terrific! I have NEVER experienced anything but positive help from the site and I was NEVER told to use laxitives OR lower calories–ever.I cannot say enough good things about the website. I tried other weight loss plans and they did not work but that Kimkins sure did! And I have medical records and pictures to prove it. Just ask me for them.

Within the Low Carb Friends postings she’s made, it’s clear she did not follow Kimkins exclusively.
In fact, through her own posts at Low Carb Friends, we learn she lost 47 pounds following Atkins, stalled for six months, moved to South Beach, then Eat Fat Get Thin, then a Fruit Rotation regiment, then Kimkins, and then finally a rotation of Atkins and Kimkins.

Yet, in the above review she attributes her entire weight loss to Kimkins. This may well be because she was the featured weight loss success recently in the Kimkins newsletter (issue 20). In that feature she states she started with Atkins and then found Kimkins when her weight loss stalled, she was frustrated and “starving and felt terrible…I was desperate.” In that feature she also willingly states she alternates between Kimkins and Atkins. This fact is curious given Kimmer’s (Heidi Diaz) disdain for Atkins and its allowance for higher fat meats and dairy. When we review the situation, it is clearer why Kimmer is open to Tippy saying many of the things she does in her success story. Kimmer is losing staff left and right and needs to replace staffers fleeing her company and site. She knows one thing about Tippy, and that’s her long standing desire to be an Admin at Low Carb Friends, a position she is now more than willing to extend to Tippy now that she, Kimmer, is desperate. We recently learned that over the years Tippy has long desired a position of Admin at Low Carb Friends and has made this desire known to many close to her, including Kimmer prior to her departure from that forum.

Last year Tippy stirred up things on a weight loss challenge thread on Low Carb Friends by being very critical of the Low Carb Friends admins at the time. She made it known she believed she was qualified to be an Admin and when a position as one was not offered, she started passing along private information about the Low Carb Friends admins behind the scenes in emails and Private Messages in an attempt to turn them on each other. In those communications we are told she alluded to questionable behavior by the Low Carb Friends Admins at a pig roast in Tennessee she attended, allegations we will not detail here, but suffice to say included implications of inpropriety between Admins whom were not married to each other.

An attention junkie like Kimmer (Heidi Diaz) she spent months attempting to garner a position of Admin within Low Carb Friends to no avail, but her desire to be one continued.

As soon as Kimmer offered an Admin position to Tippy, she jumped at it and quickly told her friends, expressing her delight at the opportunity. We’re told she said she was thrilled by the “authority” Kimmer entrusted her with and also expressed a grand plan to completely revamp the Kimkins diet plans into something she believed would be healthier and much less objectionable to those concerned over the safety of the plans as currently written.

May we remind her she need only look as far as Becky to see such changes will not be tolerated by Kimmer. Read Becky’s Reasonable Appeal to make changes and Kimmer’s reply point by point.

What is more disturbing than her less than accurate BBB review however, is that she’s taken to doing Kimmer’s biding on Low Carb Friends. In a very recent post there, she laid the groundwork to instill doubts in the minds of those concerned about Kimkins and Kimmer by questioning not only the motivation of those engaging on the Facination thread, but also attempted to lay blame for the entire situation on one individual, former business partner Catherine (whose husband is releasing details of that partnership at Slamboard).

Her post, titled Are We Being Used, includes the following,

Just a thought. Notice the person who started this thread is a junior member (meaning newly registered) and does not continue to post? Notice so many junior members coming in now? It is easy to assume they are from Kimkins site BUT I wonder about the truth in that assumption for many reasons. One, I recall Catherine telling X LCF members how easily identity can change so they could come back without admins knowing it was them… Cutie–remember that? Two, I notice the junior members seem computer savvy enough to post info and pics I would not have a clue about myself… Now I am not saying every single junior member here is ficticious. But I think many may be. Tom, can you check out this possibility? Is it possible this whole thing has been created by the ex biz partner, who is clearly mad as heck? Also, keep in mind it is the same creator of slamboards and…perhaps Ducky? Oddly enough, Catherine admits it was her idea to start a website for Kimkins–not Kimmers. So I don’t think Kimmer spent countless hours here plotting but I think Catherine did. Also, Catherine just thought Kimkins was a wonderful plan and fully endorsed and followed it, according to her. Until the partnership disolved, that is. Now it can kill you…WTH?

And the Kimkins survivors blogs… Are they real? How do we know? And the 14 year old–was that real?
The threats to anyone who is a moderator for her site–threats of fraud and lawsuits… A bully tactic for sure to intimidate them into walking out. The claims of KimATC being 50 lbs over weight…How rude was that, asking her how that Kimkins diet was working out? In fact, that statement points that Kimkins doesn’t work and we have established it does. We all have weight problems which is why we diet. The pressure is on–but by whom? The reasons seem pretty obvious.

Don’t get me wrong. I KNOW there are some of those people here in a genuine manner. I know a couple of you from her site and I know you had concerns (even if you are ALL at goal now thanks to her diet). I do not agree with cutting calories further in the event of a stall either. But perhaps Kimmer was in the learning process herself and it was a bad decision, or mistake. And maybe Kimmer did gain weight back and won’t tell. Take a good look around this site. How many people have gained their weight back and refuse to remove the skinny avitor pics and change stats accordingly? I think many of us are guilty for that.

Are we all puppets on a string being manipulated by a raging X partner?

We know in the past Kimmer has taken to manipulating situations to motivate individuals to do things they might not do on their own. An example of such behaviour in the past is the January 2007 blog by Jimmy Moore, where he attacked Low Carb Friends and did so in a scathing and vicious manner. He’s since retracted that post, but our memory is long here and we’ve been told that Kimmer’s input was indeed the impetus for that post.

It’s interesting that many of the points Tippy brought to her post at Low Carb Friends are now the same points Kimmer is trying deperately to convince her members of within the Kimkins forums. It appears much of Tippy’s post contents were scripted by Kimmer. Tippy seems unaware of the manipulative instincts of Kimmer and may not realize how she too is now being used by her as a means to an end.We ask this, Tippy how could you associate yourself with Kimmer given all the facts now in the public view?

We’d like to remind readers that this is the same Tippy Toes who organized the fundraiser for Kimmer’s (Heidi Diaz) phantom foster children last summer. Tippy accepted the position of Admin after revelation of the fact Heidi Diaz has no foster children and has not had foster children in her care since at least 2000.

BBB & California Medical Board

7 09 2007

Heidi Diaz received a complaint from the BBB recently and in responding, as requested by the BBB, she also established her business presence within their website.

From the BBB website we learn the following about Kimkins:

DBA: Kimkins
Address: 529 North McKinley Street 104-309
Corona, CA 92879
Primary Phone: (951) 258-3976 » Other
Primary Contact: Heidi Diaz,Owner

Company ID: 100055868
Business Start Date: 4/22/2006

This verifies that Heidi Diaz is the owner of the website and that the McKinley Street address (shown in the slamboard surveillance) is indeed her mailbox address for the company mail.

What is truly distrurbing about her listing within the BBB directory is her categorization of her company as within Physicians and Surgeons: Medical Weight Reduction. With no known medical professionals on staff, this is a blatant misrepresentation of her company, and implies medical suprevision that does not exist, thus we believe she’s now established cause for practicing medicine without a license in the state of California.

If you have not done so, please take some time to Write a Review for Kimkins where provided by the BBB. If you feel you have been defrauded, misled or abused in any way by the company, please File a Complaint where provided on the BBB site.

You can also call the California Medical Board to report her classification under Physicians and Surgeons: Medical Weight Reduction with the BBB so they are also aware of her deceptive business practices.

The California Medical Board phone number, for complaints, is toll-free: 800-633-2322

You may access their website here.

Don’t forget to mention is states on her website the diet is “perfect for all diabetics.”

Thank you, Ducky. Truly sorry to have clogged your blog with my recent flurry of rants. I tend to get just a tiny bit overenthusiastic about worthy causes sometimes! 🙂

(Please feel free to delete this or any other of my hyperactive comments 🙂

I feel so much better you guys! Yesterday there were no surveys on her company, now there are something like 7 pages. We all know the 5 star replies are Heidi herself, but yeah for us! Maybe this will at least stop some people from joining.

Heidi hasn’t replied to my rebuttal and I’m not so sure she will, but I’ll keep watching and see. Again, Kimmerexia is right, this will not shut her down, but hopefully it will make some think twice and the complaints filed can be used by the AG during their investigation. If we keep plugging away at the resources available to us, something will happen. She’s only one person…we have how many???

September 7, 2007 at 4:12 pm

Kim, I’ve even filed my own lenghty review myself as well just now.

But the overall ranking still currently sits at TWO stars. Gotta get it down to the minimum ONE star!

September 7, 2007 at 4:48 pm

I knew you could do it Kimmerexia! Thanks! You’re right, we have to get it down to one star. I noticed too that when I initially filed my complaint her “grade” was a C, but just in her responding to my complaint and filling out her info, she was upgraded to a BB. Hopefully with more complaints that will drop back down…below a C would be awesome!

It’s a start at least.

September 7, 2007 at 7:35 pm

Kimmer is now directly prompting her loyal members to post positive reviews at the BBB site:

Kimmer posts link to BBB review site and sez: “”Nobody loves us.”

Which solicits replies from the minions:

“Oh my God, Kimmer that’s horrible…I’ll write one right now”

“There are more of us than of them, we’ll fix this”

Kimmer sez: “So who all is going to the BBB to post some reviews?”

September 7, 2007 at 7:51 pm

LMAO – she couldn’t think of anymore names to post her own reviews anymore or what???

I just hope that on top of the reviews, those that have been banned without refunds have also filed complaints. Those complaints can’t be countered by anyone but Heidi and what leg does she have to stand on when she’s not refunding the money, but not providing the lifetime memberships either.

September 8, 2007 at 1:02 am

Kim, that’s an important point for everyone to keep in mind — the REVIEWS are not the same thing as the COMPLAINTS.

The Reviews MIGHT certainly help prevent more people being lured to this dangerous diet.

The Complaints WILL affect Kimkins’ business ratings and MIGHT help in furthering the ongoing investigation.

If you personally have been defrauded, decieved, verbally/emotionally abused by and/or harmed by Heidi/Kimmer/Kimkins diet/ AND/OR if you have not received a full refund and the promised Kimkins e-book, AND/OR if you are a family member, spouse, or caretaker/guardian of someone who fits any of these criteria, please put your keyboard where your mouth is (uh … not literally! 🙂 and file a COMPLAINT.

The rest of us can post REVIEWS.

That link again for both Complaints and Reviews is:

September 8, 2007 at 4:30 pm

Right Mimi. And I’d like to point out that her reviews are now rated at 3 stars because of her post onto her site to solicit good reviews so the complaints need to be filed, they can only be answered by Heidi herself. Just my one complaint she contradicted herself on, so imagine if she gets more, she’ll really be talking out of both sides of her mouth. It takes just a few minutes and is super easy on the web.

I think she’s starting to feel the pressure.

Petition to Investigate Kimkins

16 08 2007

To:  Federal Trade Commission, Better Business Bureau, California Attorney General

Believing it to be true that is promoting medically unsound and potentially life-threatening diet plans in which many followers have complained of one or more of the following:

• Dizziness
• Nausea
• Muscle fatigue or weakness
• Heartbeat palpitations
• Moderate to severe hair loss
• Bone and joint pain
• Mental changes – irritability, forgetfulness, confusion
• Bowel complications/symptoms of laxative abuse

And that the founder of Kimkins, known as “Kimmer” ;

• is not certified or licensed in any way to dispense nutritional and medical advice
• claims to have lost 198 lbs. but has never provided solid evidence of such loss, having refused to be interviewed in person
• has advised the daily use of laxatives extended beyond products’ warnings
• has pushed diet followers to stay as low in calories as possible, even as low as 0-300 calories a day
• has used questionable marketing techniques to generate membership revenues by:

– displaying false “before/after” testimonials
– using viral marketing techniques such as the willful misplanting that young celebrities have followed the plan in order to target a younger demographic, including pre-teens
– has allowed affiliates to spam many valid forums with misleading information
– advertising the acquisition of an e-book as included in the membership fee, which she never produced

We, the undersigned hereby request that this website, and its founder, “Kimmer” be properly investigated in an expedient manner so as to prevent harm from coming to more individuals who might try these plans.
