Well, as all can see, the call to contact WordPress by those within Kimkins to shut Ducky up was for naught. We’re still here and will remain since we are not, as we said yesterday, in violation of the TOS, nor do we plan to violate the TOS anytime soon. We carefully consider our words before publication and always remain within the boundaries of the law and the terms of service we agreed to when we registered this blog.

After careful consideration, we have edited out our ‘in jest remark’ in a post regarding SingingLass and have retained the original so as to ensure its integrity should it be needed later.

For those reading, be aware that threatening others by phone, in person, or in email is a criminal offense. It is something we abhor and we will cooperate fully with authorities if we are approached about our records here. Enough said on that matter.

This morning we’re given a treat from theTRUTH, another private message exchange between Kimmer (Heidi Diaz) and melt (a member) to highlight they are indeed two different people.

SingingLass is a bit miffed. She obviously has no clue about public records and reporting their contents online.

You Can’t Hide

Yesterday, theTRUTH treated us to more inside private communications between Kimmer (Heidi Diaz) and SingingLass; private messages from a system that only the two currently have access to because the PM system was closed to all others in an attempt to ferret out who is leaking information.

Interestingly, SingingLass seems worried that her information might have been compromised if she’d included it to Kimmer in their communications. In the PM exchange released yesterday,

We laughed, quite heartily too, as we read the latest installment from theTRUTH of the private communications between SingingLass and Kimmer (Heidi Diaz); a discussion which took place while only two people have access to the Private Message system in Kimkins.

This Just In…

Christin has a message for SingingLass and TippyToes.

I have debated about publishing the following, but after reading conversations released today by The Truth In Hiding concerning bonuses, I am going to share publicly the incentives Kimmer offered me as Public Relations Director for Kimkins.

In my previous blog, Ethics vs Economics, I eluded to having to make a financial decision to walk away from Kimkins. Believe me; I struggled with what to do. I risked losing a lot.

The following conversation was in reference to obtaining new magazine articles and contacts:

It’s starting off a banner day in the speculation department as to whom Ducky is.

First Tippytoes is sure we’re admins and members from Low Carb Friends. Now, theTRUTH posted private messages between SingingLass and Kimmer, with SingingLass offering her insights about who we are.

Thats the fun stuff. I keep the kimkins site open in my IE browser, and when I go to any of those sites or LCF, I do so seperately through aol, fav places etc…so that they cannot see a browsing trail. People get what they pay for, no advice being given for people to eat nothing but grass…..and no where in the purchasing agreement does it say that people are entitled to know your bra size or choice of toilet paper. In order to have a real case, there would have to be huge lackings in what was promised, people paying and getting nothing and the like….and also there would have to be multiple medically documented cases of people being hurt or worse, and even then only if they followed the diet correctly and it happened. Also, any self-thinking investigator who goes and looks at that LCF thread and the ducky board will be able to see it is a foaming irrational mob behind this.

I had someone saying she was eating 10-15 g of fat a day in the chat room and not losing weight. I of course told her to up that, and she was like “oooh”……there also was someone who had been silently sitting in the chat room for a long time last night…bracken666 i think it was, who thought they have had an account since june, had no posts listed in their profile. I decided to address them and say hello, and bam, they signed out. Others said he/she had been in there for hours without saying anything, so just seemed odd they ran when addressed…obviously was watching. Just little things and people like that to keep an eye out, sad we have to, but needed right now I guess.

Everything you outlined for an investigation is exactly right — but I wasn’t going to bore you with the details, LOL! I’m glad you understand and you see yourself that there’s nothing hokey going on: diet, food list, support groups and nobody being told to drink Drano or gulp laxatives.

I did get an email from the Woman’s World editor. Wanted to know if we were sending mailings to members encouraging laxative abuse. Had to set her straight on what’s happening. Ducky is running out of resources — and every morning we’re still here darn it!

BTW, this probably sounds like a bribe (hey, you can blog about it!) but I appreciate you looking out for Kimkins. I’ll remember that. I believe a gift between friends is non-taxable, yes? You’ll have something to look forward to at Christmas. (theTRUTH emphasis added)

We know Kimmer lacks any moral compass from all we’ve read, seen and heard.

Boy, oh boy, today is simply a feast for the eyes from theTRUTH!

When she said that, she suddenly got this wave of people telling her way to go, and let me know so I can join in too. Following that, ducky made posts cheering her on and encouraging others to join on the wagon as well. I think at first there was not even a lawyer, that she was just blowing steam to look cool, and it jumped foward.

Now, other interesting issues. You have to lift a brow at a so-called lawyer who is posting on other random anti-kimkins blogs in the comment sections trying to drum up people to join up with him. Can we say bottom feeder, and a blow to credibility/ethical practices? Secondly….this is based on people wanting their money back. Not thousands, not hundreds…but rather clogging up court time and expenses for $60 memberships to a web service that they violated tos on, but still have access to the diet info itself. I know other web services, be it aol, games and the like, reserve the right to ban members for infractions without warning, regardless if they paid a membership fee.

Thirdly, they have to proove claims that they really were jipped/ frauded in some way, or physically damaged. So for the first part of that, an investigation will show that all diet information and support was in fact, and still is, provided as detailed in what people will receive for thier membership fee. However, no where does it say they are entitled to know your personal life details.

Next. medical claims. They cannot just say, ” oh, i felt dizzy, i had some hair loss….” they have to have medical documentation…which means doctor records of the complaints AND saying that it was specifically caused by the diet. Even when I had a lawsuit many years ago from a car accident, I could not just say ” My neck and chest have hurt since the accident”. I had to go to multiple doctors, get xrays, and have written statements provided by the doctors detailing my injuries, and confirming that they were indeed a result of the accident, and nothing else. These people, one, are doubtful to want to go to that kind of expense and hassel, if they even realize at all that they need to go through those kind of procedures….and secondly, saying they once felt dizzy or something, cannot be prooven or even tested by a doctor, especially if they are not even following the plan anymore…they cannot contribute to hearysay and speculations like that, they would risk their own medical credibility. Even if they do go to a doctor, and say, come up with an underactive thyoid or something, they cannot in any way proove that it was not a pre-exisiting condition before the diet, unless maybe if they had been tested recently before starting it and have some kind of proof. I know my own thyroid tests bounced from being normal and underactive almost every other time I was tested as well.

I have been telling a couple others who have asked me as well that the site is not going anywhere, and not to listen to the rumors or scare tactics being produced by others. What a crazy time!

Look how many years it took them to ban ephedra….and they needed all those court actions, all those documents of people dying, and it still is being brought back up and contemplated. I don’t think any of the makers even were sued, just told they could not make it anymore. And personally, I think ephedra can be a helpful substance—when used CORRECTLY, and in regulated doses. It helped even to open my air ways in various products when I was sick.

She makes some good points. Doing a Kimmer, are we listening and taking what we need from this? Everybody with health issues, can you get documentation? Not that it really matters, since there is enough proof of the starvation response in research to make a judge go hmm. Besides, she’s ignoring the fraud part where the creator of the diet solicited memberships based on her “success.” Keep talking. (Did Kimmer reply?)

I agree with SL that it would take years to prove that the diet was culpable for any kind of illness. It probably isn’t a good thing to fight out in court at this time.
HOWEVER- The banning of members for fake TOS violations, not refunding based on the fake violations, not providing the product that the members paid for, seriously false advertising, violating CA business ethics laws, collecting funds for non-existent foster children, using multiple aliases to skirt taxes and collecting SSD under false pretenses…………..

Since I am featured so prominently in this, can I respond?

1.) Yes, I did get the ball rolling for the lawsuit

2.) I joined LCF in 2004 back when Kimmer was still there so I didn’t just come on the scene. Of course, I wanted to know what was going on, I had spent my hard-earned money to join Heidi’s site and every question that I asked about Kimkins in the past (on Kimkins and Jimmy’s blog) had been quickly swept aside. As far as my negative opinion of Kimkins – it has been there for quite some time, LCF and Kimkins simply did not allow you to express it in their forums – they did the same thing you spend all day doing – hitting the delete button, sweetie.

3.) Yes, I was banned the day the pictures were released and yes, I became more vocal at that point because that was when I realized that I had been conned and it was high time somebody did something about the fraudulent website of which you are so prominently involved.

4.) I was cool when I came out of my moma’s womb in 1978, you don’t know me so don’t act like you do.

5.) I got a lawyer the day after I was banned. Speak what you know or shut up, baby doll.

6.) This lawsuit is not simply about a refund, but about ethical business practices. Just because we are on the Internet does not mean you can lie to people and take their money.

7.) John E. Tiedt is an ethical attorney who has decades of litigation experience and is a health fraud advocate who serves on the Health Fraud Task Force for the Attorney General’s office in the State of California. You sure you want to call him a bottom feeder and face libel charges yourself?

8.) We don’t have to prove a thing. Heidi has to prove that she is 118 pounds.

9.) As far as Kimkins.com not going anywhere, you might want to get Heidi to meet you in person and prove her claims before you go making promises that you are in no position to keep.

I’d like to chime in on the legal issue (again, this is what I do for a living and have to offer)…Kimmer is the one who has to prove she lost the weight and kept it off. This is her marketing tactic. She is being accused of false marketing tactics – SHE has the burden to prove she is/did what she said.

Kimmer is selling lifetime memberships and then banning people. This is also illegal. Lifetime means just that…lifetime. You don’t have to be a rocket scientist to figure that out. The TOS has been changed repeatedly to include the “no negativity”, etc. clauses. Here’s the thing…you can and are allowed to change the TOS of any contract HOWEVER, you have to notify EVERY PERSON that the change effects. So in short, banning someone, then saying “we changed the TOS” doesn’t cut it. I, for one, never did anything negative on that site whatsoever and was banned for filing a BBB complaint. I have the e-mail from Kimmer herself stating that she banned me because I seem to be unhappy with the site. So in her own words she didn’t ban ME for a TOS violation or anything negative. She banned ME because she had an opinion and felt she was Godlike.

I have looked up the attorney, and not just through his website. He is a legitimate attorney. My best friend is a paralegal for a class action attorney in this area and he knew who this attorney was by me just mentioning his name and said “Oh, he’s a good one.” And yes, it took 10 years on the ephedra case…wake up SL – a basic lawsuit over a car wreck takes about 5 years to get the court system anymore. I won’t go into details about why it takes that long, you wouldn’t comprehend it if I tried. Also remember, most of us aren’t in this for the money. We aren’t the ones selling our souls for $150 a week. We want Heidi stopped! Have you even figured out how many hours you work on that site helping her con people and then figure out what you’re making an hour with that measily $150? I’m sure it’s about $2 an hour, if that. Well worth it, I’m sure.

Just one more little tidbit of advice SL – PLEASE, OH PLEASE….take your $150 weekly bribe and get a dictionary or install a spellcheck program on your computer. Besides talking out your @$$ about things you have no clue, you make yourself look even dumber by not being able to spell basic third grade words. If you want to play lawyer, go ahead…but that’s illegal too – kind of like dispensing medical advice without a license. Both will get you thrown in jail.

She mentioned having to go through the ringer and getting a lot of documentation about her injuries after an auto accident. It seems that she pursued this and took the insurance company to court… maybe did a settlement out of court. That case is one individual utilyzing a personal injury (tort) attorney to file a claim against an insurance company for monetary compensation.

IN the case of a class action lawsuit, the same is not applicable. Havent you ever received a class action notice in the mail and all you had to do to participate was sign a paper? It would be interesting to get more detail on this though.

I’m also wondering how long this information source (internals message amongs admins) is going to be available if they read these boards. I would think they would have already gone to another method of communication or will start to say things just to mess with the mole.

Getting to Know SingingLass

SingingLass is yet another staunchly loyal admin at Kimkins. Since it’s apparent she has no plans to leave the sinking ship today, we thought we’d add her profile at this time.

SingingLass’ name is Delaney. She’s frequented many message boards prior to joining Kimkins. In fact, she was a prolific poster at Low Carb Friends until a few months ago. Her last post in that forum was June 26, 2007.

Yesterday she scurried around the internet editing content of posts made back in 2002 when she started posting online and happened to reveal a tragedy in her teen years. We are not making light of this incident, but are including it only to show that she is well aware of what she is currently doing inside Kimkins and that her past posts remain fair game in all this.

The cache of her original posts remains. It may help explain her pathology in all of this with Kimkins. We’ve included it for accuracy, not entertainment and are truly sorry she had to experience such a violation in her youth.

While she’s singing the praises of Kimkins these days, she has had health complications while on the diet.

Well, despite how little I have been eating….not only did I not lose anything the last four days, but it shows me as being a pound up. ::sniffle::

I have been really sluggish today…got up for a couple hours then fell back asleep at noon for almost another four, and STILL feel tired. My legs are also very sore, at first I was what the….then remembered I spent several hours sitting in a folded kneel position yesterday while putting together the photo board. Headachey too. I guess just everything that has been going on and rushing around, lack of sleep ect……would have felt better if I had seen some weight loss though.

In a hair forum online she was scolded by the moderators for her unbelievable advice about hair loss.

But, what we find rather amusing is that in her profile she includes among her occupation(s) ‘Psychic Consultant’, which may explain her rather bizarre rants in private messages and private admin forum posts with Kimmer.

There you have it, some history on the one and only SingingLass who is quick to ban and remains at Kimkins. As we have for the other admins, we’re issuing a reminder that remaining on staff with Kimmer (Heidi Diaz) may be considered aiding and abetting.

Perhaps you should leave now SingingLass?

But it seems obvious by her own words that she wants/needs to feel needed and Heidi is undoubtedly giving her what she needs in that category. 1. Posting someone’s tragedy like that, let alone something that occurred to a child… as a form of entertainment is down right low, wrong, if not sick. That has nothing to do with any of this or kimkins. Shame on anyone associated with someone who would stoop to such measures.

2.The post taken out of context about not eating much…was because my grandmother had just passed away and I was GRIEVING, and staying with family where low carb choices were limited. The photo board mentioned was constructed for my grandmother’s memorial.

3. That hair board thing was actually some post someone else made copying what was put up here at kimkins exposed, which was a twisted version of my original post on kimkins that was taken out of context .

While you are at it, how about drag around through the mud that I have two degrees after putting myself through college, and am a formally trained opera singer. I am sure people will find lots of fault there. 🙂

To anyone who uses my childhood experiences as entertainment, humor, or message board fodder…please think of your own daughters, sisters…mothers, your own experiences, and how you would feel for them to be put on display in such a callous manner. Regardless of what is going on with kimkins, I would hope and think that others out there would agree that is no where appropriate and request it be removed and kept out of this.

Additionally….I just wanted to add, that the post being displayed detailing childhood experiences and PTSD was over five years ago during a difficult time. For anyone concerned, I have long since dealt with those issues, and am at present very content with myself and my life….in fact, I am very proud of the things I have accomplished for myself against those kind of odds. I still however think, using that kind of information in this context is wrong and is a violation of anyone who has had experiences of that nature.

I can’t speak for others, but I don’t see how anyone here sees SingingLass’s tragedy as entertainment. What it does do is provide some background as to why she seemingly enjoys the power of being an admin, someone who has control over others and can do to them what she wants.

I think it’s really hard for her to step back and see that she’s not very nice in the Kimkins forums and that she’s treating many, many people badly.

And we all know if you don’t want something public, don’t post it on the internet in a name you’ll be recognized under. Better yet, don’t post it online at all!

SingingLass, as others have begged you, it’s time for you to really look at all of this and realize we are not “haters,” nor are we “jealous,” nor are we trying to foil yours or anyone else’s weight loss. No, we’re trying to bring a criminal to justice and you happen to be in the way!

SingingLass- I am so sorry for all the bad in your life and I am happy to hear that over the past 5 years you have been able to overcome it. i’m sorry, but I do agree with Ducky on the point of being an admin makes you feel needed. I don’t agree that your story should have been posted here, but YOU did post it for the whole world to see. I was still on the Kimkins boards when you first became an admin and you do take your “position” way to far and serious. I do hope for all the wrong you are doing that you are atleast getting paid. (Not saying getting paid makes it right). I too hung on after all the contraversy (sp) first strted hoping Kimmer would prove all the anti-kimkinners wrong, but she didn’t and want. She doesn’t even try to defend herself.

You where so quick to jump in about how wrong it is to post your life, so plese jump in here and tell us what you think is Kimmers side. Did she lose weight? Does she have foster kids? Is she a fraud? Are you going down with her? Why isn’t she defending herself when she knows there are lawsuites agianst her? And please be as bold as you are on the kimkins site when you are banning people for having questions.

I am going to sound like a total bitch, but I don’t care.

I was molested by my real father from about 3-9. I was raped at 16. Yeah it sucked, and I do not wish it on anyone.

I think for SL to try and hide behind those things is the biggest but of bullshit I have ever heard.

She sickens me. Many, many people have gone through traumatic things and are not power-hungry jerks with their heads up their ass.

I hope she rots in hell right next to Kimmer and Tippy Toes.

It is horrible what happened to you and I don’t think anyone is making light of it. . . but what you’re doing over there is horrible, too. Unfortunately, lots of individuals who have been abused turn into abusers themselves. You are VERY harsh sometimes when posting to people there. . . you are scaring people over there, censoring them, and making them feel shunned & alone. . . you didn’t like it, why would you want to do it to anyone else?

Please listen when Becky tells you that Heidi is NOT your friend; she does not care for you, she only cares for herself. Kimkinssmith and others here DO care about you. . .listen to them and break the cycle and finally break free.

I’m so glad I never trusted in Kimmer that much.

When I first joined in June (and not from WW…I didn’t even know about it!), I was so stoked to realize that she really did PM people. I had just had a ‘trigger’ in my own life which brought on much of the same pain SingingLass spoke about. For me, I felt if I lost the weight, all those parts of me would fade. They never bothered me growing up.

I nearly PMed and told Kimmer all about it in hopes I’d get affirmation, something…I’m so glad I didn’t.

I’m well now, but still…wow. Thank the heavens.

This whole thing confirms that my radar isn’t totally broken. While I fell for Kimmer’s lies and need to destroy others, I always felt that SingingLass wanted to be an admin over at KK’s to be loved and accepted. Call it women’s intution! Hey, we ALL want to be accepted, so no shame in that, SL! But, you need to protect yourself and go ahead and admit that you fell for K’s lies like a lot of good folks did. You are getting used. Be strong! Don’t let someone like her take advantage of you – GET OUT NOW.

SingingLass, no one is laughing at your past. What you endured is horrible and criminal, and no one should have to suffer through those things.

BUT, lot’s of people were abused and mistreated as a child. I was, too… please don’t use that as an excuse to mistreat others! Go the other way– use that heightened sensitivity to care for others, to help them. And no, verbally abusing Kimkins visitors and fronting a fraud DOES not count as help.

I understand that it’s tempting to want to grab power wherever you can. You had no control as a child and now you do… it’s a strong urge, but fight it! You don’t want to be an abuser. You’re a surviver… and you’re better than that.
